• Could give rise to civil or criminal liability under applicable law. User Content License Grant. By submitting User Content through our Services, you grant Target Stream Media Inc. a worldwide, non-exclusive, perpetual, royalty-free, fully paid, sublicensable, and transferable license to use, edit, modify, reproduce, distribute, display, perform, and otherwise fully exploit such User Content in connection with our Services and business — including for promotional purposes — in any media format and through any media channel, including after termination of your Account. This license grant does not affect your other ownership rights in your User Content. You represent and warrant that you have all rights necessary to grant this license without infringing any third-party rights.

11. Intellectual Property Rights

You acknowledge and agree that the Services and all Content — including AI tools, frameworks, methodologies, reports, and materials — are the property of Target Stream Media Inc., our licensors, or other authorized providers, and are protected by United States and international intellectual property laws. No right, title, or interest in or to the Services or any Content is transferred or granted to you under these Terms of Service. All rights not expressly granted are reserved by Target Stream Media Inc. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED THROUGH THE SERVICES WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS. YOU ASSUME ALL RISK FOR ANY DAMAGE RESULTING FROM YOUR USE OF OR ACCESS TO THE SERVICES. ACKNOWLEDGEMENT. YOU SPECIFICALLY ACKNOWLEDGE THAT TARGET STREAM MEDIA INC. SHALL NOT BE LIABLE FOR: (I) USER CONTENT SUBMITTED BY THIRD PARTIES; (II) THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY; OR (III) ANY OPERATIONAL OR BUSINESS OUTCOME RESULTING FROM YOUR USE OF OR RELIANCE ON OUR SERVICES OR AI TOOLS, AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS SOLELY WITH YOU. Releases. You hereby release Target Stream Media Inc. and its directors, officers, employees, agents, subsidiaries, affiliates, successors, assigns, service providers, insurers, and advisors from all claims, demands, and damages of every kind — known and unknown, direct and indirect, suspected and unsuspected — arising out of or in any way related to Content accessed through the Services or any interactions with others arising therefrom. 18. Governing Law and Jurisdiction

The United Nations Convention on Contracts for the International Sale of Goods shall not apply. You agree to submit to the exclusive jurisdiction and venue of the state and federal courts of New Hanover County, North Carolina for any legal matters arising out of or relating to these Terms of Service. YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

19. GDPR

This Website is intended primarily for users residing outside of the European Union and United Kingdom.
